Equal Credit Opportunity Act - Elimination of Disparate Impact

The Consumer Financial Protection Bureau (CFPB) issued its final rewrite of Subpart A of Regulation B (Reg B) under the Equal Credit Opportunity Act (ECOA), which eliminates disparate impact from enforcement of ECOA, clarifies the prohibition on discouraging prospective applicants, and establishes new restrictions on special purpose credit programs (SPCPs).

The final rule provides that the ECOA does not authorize disparate impact liability. This is accomplished by the final rule removing:
  • All "effects test" references from Reg B and the official commentary. In addition, the final rule states that the ECOA does not recognize the effects test and the commentary recharacterizes the ECOA as a disparate-treatment-only statute; and facially neutral criteria are actionable only where they are intentionally designed or applied as proxies for prohibited characteristics.

The final rule takes effect on July 21, 2026.
I. Discouraging Prospective Applicants
While the final rule retains the discouragement prohibition, it has been significantly narrowed, compared to prior interpretations. Specifically, the rule focuses on statements reflecting an intent to discriminate rather than prior interpretations based on consumer perception or indirect outcomes.

Section 1002.4(b) now prohibits only oral or written statements — including visual images — that are directed at applicants or prospective applicants and that the creditor knows or should know would cause a reasonable person to believe the creditor would deny credit, or offer it on less favorable terms, because of a prohibited-basis characteristic.

​Restrictions on for-profit special purpose credit programs (SPCPs): The final rule prohibits for-profit SPCPs from using race, color, national origin, or sex — or any combination of those characteristics — as a common characteristic or eligibility factor, and new written plan and per-participant evidentiary requirements apply where other otherwise-prohibited bases are used.
